Miraq – Terms of Service

Last updated: October 25, 2026

These Terms of Service ("Terms") govern the use of Miraq's website, digital music products, downloadable audio files, and music licensing services. Separate terms may apply to specific services, including Q-Ritmos Radio.

By purchasing a music license, downloading a digital product, or using a service governed by these Terms, you agree to the applicable terms. Nothing in these Terms limits any mandatory rights you may have under applicable law.

1. Overview of Services

Miraq Media ("Miraq") provides rhythm-driven digital music products and licensing options for dancers, DJs, content creators, and media professionals.

Our services include:

  • Music licensing: Original music tracks offered under the Creator License and Producer License, subject to the terms of the selected license.
  • Digital downloads: Full stereo tracks and, where included in the selected license, individual audio stems.
  • AI-assisted and other music: Miraq uses artificial intelligence tools to generate, arrange, process, and curate parts of its music catalog. Miraq may also offer music created through other methods, including human-authored or hybrid productions.
  • Separate listening services: Miraq may offer radio, streaming, or other music-listening services under separate terms of use.

Miraq operates as a digital platform and does not sell or ship physical goods.

2. Licensing Structure for Music Tracks

Music tracks available through Miraq are offered under specific licenses. The permitted uses, restrictions, and included features depend on the license purchased.

Miraq's licenses are intended to provide royalty-free usage rights within the scope of the selected license. Royalty-free means that no ongoing royalties are payable to Miraq for uses permitted under that license. It does not, by itself, guarantee that no third-party rights, statutory licensing requirements, or other obligations may apply in a particular situation.

The applicable license determines which uses are permitted and whether features such as stems, editing, remixing, or professional distribution are included. Customers should review the license information displayed on the Miraq website and the relevant product details before purchasing.

2.1 Creator License

The Creator License is designed for content creators, dance professionals, DJs, instructors, and projects within the scope of the Creator License.

Permitted uses include the uses expressly listed for the Creator License on the Miraq website, such as applicable digital content, social media, dance activities, and other listed uses.

Restrictions:

  • The Creator License does not include individual audio stems.
  • Editing is limited to the adjustments permitted under the Creator License. It does not grant the broader editing, remixing, or rearrangement rights included in the Producer License.
  • The license is non-exclusive. Miraq may license the same track to other customers.

The Creator License does not transfer ownership of the underlying track.

2.2 Producer License

The Producer License is designed for productions and workflows requiring stems and broader audio editing rights.

It includes the uses permitted under the Creator License, together with the additional rights and features specified for the Producer License on the Miraq website.

These additional features include:

  • Stems: Access to the individual audio stems supplied for the licensed track.
  • Extended production use: The additional commercial and professional uses expressly included in the Producer License.
  • Editing and remixing: The right to edit, remix, rearrange, and adapt the supplied audio within the scope of the license.
  • Hybrid works: The right to combine Miraq audio with human-created elements, such as original lyrics, vocals, or newly performed instruments, where permitted by the license.
  • Modified releases: The right to publish and distribute qualifying modified works where this is expressly permitted by the Producer License and subject to Section 2.3.

The Producer License is non-exclusive. Purchasing it does not grant exclusive ownership of the underlying Miraq track or prevent Miraq from licensing that track to other customers.

2.3 Prohibited Uses Under All Licenses

Regardless of the license purchased, customers must not:

  • Resell, sublicense, share, or redistribute the original tracks, stems, or modified versions as standalone music assets, loops, samples, sound packs, or components of a competing music library.
  • Register Miraq tracks, stems, or derivative works incorporating Miraq audio with automated content identification, digital fingerprinting, copyright enforcement, or monetization systems in a way that claims or restricts the music as the customer's exclusive content. This includes systems such as YouTube Content ID, Meta Rights Manager, and TikTok Music ID.
  • Register Miraq music, stems, or derivative works incorporating Miraq audio with a performing rights organization, collecting society, or similar organization as the customer's own exclusive creation.
  • Use Miraq music, stems, or associated metadata for text and data mining, machine learning, or training artificial intelligence models, to the extent such use is restricted by applicable law or rights reserved by Miraq. Miraq reserves applicable rights concerning text and data mining, including where permitted under Article 4(3) of Directive (EU) 2019/790.
  • Submit Miraq music or stems to generative AI tools for the purpose of generating automated derivative works, variations, or vocal replacements.
  • Remove, alter, or circumvent digital watermarks, C2PA data, provenance information, or other technical identifiers embedded in the files.
  • Use Miraq music for unlawful purposes or in connection with content that is defamatory, hateful, or otherwise unlawful.

Nothing in this section prohibits uses that cannot lawfully be restricted under applicable mandatory law.

3. Q-Ritmos Radio and Other Listening Services

Miraq may offer Q-Ritmos Radio or other music-listening and streaming services.

These services are distinct from Miraq's downloadable music products. Their availability, permitted uses, access conditions, restrictions, and any applicable fees will be described in separate terms of use made available on the relevant service page.

Where separate terms apply, those terms govern the use of the relevant listening service. These Terms do not replace or provide a complete set of rules for Q-Ritmos Radio.

4. Artificial Intelligence Transparency

Miraq uses artificial intelligence tools in the generation, arrangement, processing, and curation of parts of its music catalog. Individual products may be identified as AI-generated or AI-assisted where applicable.

Downloadable files or streams may contain metadata, digital watermarks, provenance information, or other technical identifiers associated with their creation or processing.

Third-party platforms, including YouTube, TikTok, and Meta, may detect such identifiers or apply their own AI-related labels, classifications, or content policies. Miraq does not control those external systems and cannot guarantee how third-party platforms will classify or display content.

Customers are responsible for complying with the rules and disclosure requirements of any third-party platform on which they use Miraq music.

5. Audio Stems

Where included in the purchased license, audio stems are supplied to support editing, remixing, rearrangement, and other permitted production workflows.

Stems are provided in the form available for the relevant track. Because audio generation, rendering, and separation processes can produce imperfections, stems may contain minor bleed, artifacts, or variations.

Such imperfections do not automatically mean that a product is defective. Mandatory consumer rights relating to defective or non-conforming digital content remain unaffected.

6. Delivery of Digital Products

Digital purchases, music tracks, and applicable stem files are delivered electronically through download links or other access methods made available following successful checkout.

Delivery is generally considered completed when the purchased digital content has been made available to the customer for download or access, subject to applicable law and the customer's statutory rights.

Customers are responsible for having compatible equipment, software, and internet access needed to download and use the files.

If a download link does not work or purchased content cannot be accessed because of a technical problem attributable to Miraq, customers may contact media@miraq.app for assistance.

7. Withdrawal, Refunds, and Consumer Rights

Miraq provides digital content that may be made available immediately after purchase.

Where required by applicable law, customers are informed before completing their purchase about the conditions affecting their statutory right of withdrawal.

Immediate digital delivery and withdrawal rights: Where the applicable legal requirements permit an exception to the statutory right of withdrawal for digital content, the customer is asked during checkout to expressly request immediate delivery and acknowledge the effect this may have on the right of withdrawal.

Miraq uses Payhip's checkout process for this confirmation. The relevant confirmation is recorded through the checkout system.

Where all applicable legal requirements for the exception have been met, the customer may lose the statutory right of withdrawal once delivery or performance begins, as provided by law. This does not remove any rights that the customer retains under mandatory consumer protection legislation.

Defective or non-conforming digital content: Nothing in these Terms excludes or restricts mandatory consumer rights relating to defective, non-conforming, incorrectly supplied, or inaccessible digital content. Where applicable law provides a right to repair, replacement, price reduction, termination, refund, or another remedy, that right remains unaffected.

Customers who believe that purchased digital content is defective, materially different from the agreed product, or inaccessible due to a technical problem attributable to Miraq may contact media@miraq.app, describe the issue, and indicate the assistance or remedy requested.

Nothing in these Terms excludes, restricts, or replaces any mandatory consumer protection rights that cannot legally be excluded or limited.

8. Intellectual Property and Commercial Use

Purchasing a Miraq license grants the customer the usage rights specified in the selected license. It does not transfer ownership of the underlying music or grant exclusive rights to the track.

Miraq retains its contractual, administrative, and licensing rights in the music products and recordings it makes available, subject to applicable law and the rights of any other relevant rights holders.

AI-generated material: The availability and scope of copyright protection for AI-generated material depend on applicable law and the circumstances of its creation, including the presence and extent of human authorship. Miraq's licenses set out the contractual permissions it grants for use of its products; they do not guarantee that every element of a track qualifies for copyright protection.

Hybrid works: Where a customer combines Miraq audio with independently created human-authored elements, any rights in those additional elements depend on applicable law and the circumstances of their creation. The underlying Miraq audio remains subject to the applicable Miraq license and may continue to be licensed to other customers.

Customers must comply with the restrictions in Section 2.3, including the restrictions on claiming Miraq audio as their own exclusive work through rights-registration or automated content-identification systems.

9. Limitation of Liability

Miraq aims to provide its digital products and services as described on the website. To the maximum extent permitted by applicable law, Miraq does not warrant that every product will be suitable for every intended use, that third-party AI systems will produce consistent results, or that external platforms will treat or classify content in a particular way.

Miraq cannot guarantee that laws, regulations, platform policies, or interpretations concerning AI-generated content and intellectual property will remain unchanged. This does not exclude liability that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, Miraq is not liable for indirect or consequential losses arising from the use of, or inability to use, its digital products or services. This limitation does not apply where such liability cannot legally be excluded or limited.

Customers are responsible for selecting a license appropriate to their intended use and for complying with the applicable license terms and third-party platform requirements.

Nothing in this section limits mandatory consumer rights or any other liability that cannot lawfully be excluded or limited.

10. Account Suspension and Termination

Miraq may suspend access to a service, restrict downloads, or terminate an account where reasonably necessary in response to:

  • A material violation of these Terms, an applicable license, or applicable law.
  • Unauthorized redistribution, sublicensing, or resale of music files or stems.
  • Attempts to bypass technical restrictions, scrape the platform, or extract protected streams or files without authorization.
  • Fraudulent payment activity, abusive chargebacks, or actions that materially harm the platform or its infrastructure.

Any suspension, termination, or restriction will be subject to applicable law and any mandatory rights of the customer.

Where a material violation justifies termination of a relevant license, Miraq may take action in accordance with the applicable license and law.

If Miraq closes or changes a service for operational reasons unrelated to a customer's breach, previously purchased licenses remain subject to their agreed terms, except where a different outcome is permitted by applicable law or the relevant license agreement.

11. Technical Limitations and Security

Miraq aims to maintain reliable access to its digital store and products. Temporary interruptions may occur because of maintenance, internet routing failures, third-party hosting problems, technical faults, or events beyond Miraq's reasonable control.

Customers must not bypass platform security, download tokens, access controls, or technical protection measures. Unauthorized automated extraction of music files or metadata through scripts, bots, crawlers, or similar methods is prohibited.

Nothing in this section limits rights that customers may have under mandatory applicable law.

12. Privacy and Data Protection

Miraq processes personal data in accordance with its Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR).

Personal data may be processed as necessary for digital delivery, payment processing, license administration, customer support, fraud prevention, and compliance with legal obligations, as further described in the Privacy Policy.

Customers should consult the Privacy Policy for details about the data processed, the purposes and legal bases of processing, data retention, and their applicable rights.

13. Governing Law and Dispute Resolution

These Terms and Miraq licensing agreements are governed by the laws of Finland, subject to any mandatory legal provisions that apply.

Business customers (B2B): Disputes arising from these Terms or a licensing agreement are subject to the jurisdiction of the competent courts of Finland, unless mandatory law provides otherwise.

Consumers: Nothing in these Terms deprives consumers of mandatory consumer protection rights or jurisdictional protections available to them under applicable law, including applicable European Union consumer protection rules.

14. Changes to These Terms

Miraq may update these Terms from time to time to reflect changes in its catalog, licensing arrangements, legal requirements, or platform functionality.

Updates will not retroactively remove mandatory consumer rights or materially alter previously granted licenses except where permitted by applicable law or the relevant license agreement.

Where required by law, Miraq will provide notice of material changes or obtain any necessary consent. Continued use of a service following an update constitutes acceptance of the revised Terms only to the extent permitted by applicable law.
